Notes on data protection
With this privacy policy, we would like to inform you about how we process personal data and inform you about your rights. We are aware of the importance of the processing of personal data for you as a concerned user and accordingly observe all relevant legal requirements. Definitions
This data protection declaration makes use of the terminology of the General Data Protection Regulation (DSGVO).

“Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Processing” means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

“Restriction of processing” means the marking of stored personal data with the aim of limiting its future processing.

“Profiling” means any type of automated processing of personal data that consists of using such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects relating to that natural person’s job performance, economic situation, health, personal preferences, interests, reliability, behavior, location or change of location.

“Pseudonymization” means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separate and is subject to technical and organizational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.

“File system” means any structured collection of personal data accessible according to specified criteria, whether such collection is maintained centrally, decentrally, or on a functional or geographical basis;

“Controller” means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for under Union or Member State law.

“Processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

“Recipient” means a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not a third party. However, public authorities that may receive personal data in the context of a specific investigation mandate under Union or Member State law shall not be considered as recipients and the processing of such data by the said authorities shall be carried out in accordance with the applicable data protection rules in accordance with the purposes of the processing.

“Third Party” means a natural or legal person, public authority, agency or other body, other than the Data Subject, the Controller, the Processor and the persons authorized to process the Personal Data under the direct responsibility of the Controller or the Processor.

“Consent” means the data subject’s freely given, informed and unambiguous indication of his or her wishes in the form of a statement or other unambiguous affirmative act by which the data subject signifies his or her agreement to the processing of personal data relating to him or her.

Processing operations
We collect and process the following personal data about you:

  • Contact and address information, if you have provided us with your contact information or registered on our site,
  • Online identifiers (e.g. your IP address, browser type and version, related operating system, referrer URL, IP address, file name, access status, amount of data transferred, date and time of server request),
  • Payment information, if you have transmitted the same to us,
  • social media identifiers.

Processing purposes
We process your data for the following purposes:

  • to process your contact request,
  • to process contracts with you,
  • for advertising purposes,
  • to send the e-mail newsletter if you have registered for it
  • for quality assurance and
  • for our statistics.

Legal basis for data processing
Your data is processed on the following legal bases:

  • Your consent according to Art. 6 para. 1 lit. a) GDPR,
  • for the execution of a contract with you according to Art. 6 para. 1 lit. b) GDPR
  • to fulfill legal obligations according to Art. 6 para. 1 lit. c) GDPR or
  • for a legitimate interest according to Art. 6 para. 1 lit. f) GDPR.

Legitimate interests
If we base the processing of your personal data on legitimate interests iSv. Art. 6 para. 1 lit. f) GDPR, such are.

  • The improvement of our offer,
  • the protection against misuse and
  • the maintenance of our statistics.

Data sources
We obtain the data from you (including about the devices you use). If we do not collect the personal data directly from you, we will also tell you the source of the personal data and, if applicable, whether it comes from publicly available sources.

Recipients or categories of recipients of the personal data
When processing your data, we work with the following service providers who have access to your data:

Data transfer to third countries outside the European Union takes place. This takes place on the basis of contractual regulations provided for by law, which are intended to ensure adequate protection of your data and which you can view on request.

Storage period
We store your personal data only as long as it is necessary to achieve the purpose of processing or the storage is subject to a legal retention period.

  • if we need the data to perform a contract, at most for as long as the contractual relationship with you exists or legal retention periods run,

Your rights
You have the right – partly under certain conditions,

  • to request information about the processing of your data free of charge, as well as to receive a copy of your personal data. Among other things, you can request information about the purposes of processing, the categories of personal data that are processed, the recipients of the data (if a transfer takes place), the duration of storage or the criteria for determining the duration;
    rectify your data.
  • If your personal data is incomplete, you have the right, taking into account the purposes of processing, to complete the data;
  • To have your data erased or blocked. Grounds for the existence of an erasure/blocking claim may include withdrawal of consent on which the processing is based, the data subject objects to the processing, the personal data have been processed unlawfully;
  • to have the processing restricted;
  • to object to the processing of your data;
  • revoke your consent to the processing of your data for the future; and
  • complain to the competent supervisory authority about unlawful data processing.

Requirement or obligation to provide data
Unless expressly stated at the time of collection, the provision of data is not required or obligatory. Such an obligation may result from legal requirements or contractual regulations.

Hubspot
We use the HubSpot service of HubSpot Inc., 25 First Street, Cambridge, MA 02141, USA (hereinafter “Hubspot”) for marketing, sales, and administrative purposes, such as organizing our customer relationships, contacting users of our website, determining which of our company’s services are of interest to you, or processing user inquiries efficiently and quickly.
For this purpose, we process personal data from you, which is transmitted via a contact form, among other things.
So-called “web beacons” are also used and cookies are also set, which are stored on your computer and enable us to analyze your use of the website. Hubspot analyzes the information collected (e.g. IP address, geographical location, type of browser, duration of visit and pages viewed) on our behalf in order to generate reports about the visit and the pages visited by. Cleverreach
We use the service CleverReach of CleverReach GmbH & Co. KG, CRASH Building, Schafjückenweg 2, 26180 Rastede, Germany (hereinafter “CleverReach”), to send and analyze newsletters to newsletter subscribers.

The data entered for the purpose of receiving newsletters (e.g. e-mail address) is stored on CleverReach’s servers in Germany or Ireland. CleverReach offers statistical analysis options of usage data. This includes, among other things, information on whether an e-mail reached the recipient or was rejected by the server. The sent newsletters allow the analysis of the behavior of the newsletter recipients. Among other things, it is possible to analyze how many recipients opened the message and how often which link was clicked and whether a predefined action (e.g. purchase of a product on our website) was carried out after clicking on the link in the newsletter. We do not use individual evaluations related to the e-mail address.

The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). This can be revoked at any time by unsubscribing from the newsletter. The data processing operations that have already taken place remain unaffected. If you do not want any analysis, you must unsubscribe from the newsletter. A link is provided in each newsletter for this purpose.

We inform our customers of important changes and innovations by e-mail. This information serves the sole purpose of being able to guarantee the contractually owed service. The legal basis for sending these e-mails is Art. 6 (1) lit. b DSGVO, as the information is necessary for the performance of the contract.

The data deposited with us for the purpose of receiving the newsletter will be stored until your
newsletter is stored by us or the provider until you unsubscribe from the newsletter and is
deleted from the distribution list. After you have unsubscribed, your e-mail address will be stored by us or the provider in a blacklist, if necessary, in order to prevent future mailings. This serves both your interest and our interest in complying with the legal requirements for sending newsletters (as defined in Art. 6 Para. 1 lit. f DSGVO). If the data processing is based on our legitimate interest, you can object to the processing at any time with effect for the future.

LinkedIn Insight Tag (LinkedIn Pixel)
We use the service LinkedIn Insight Tag, a service of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland, (hereinafter “LinkedIn”) to display advertisements on LinkedIn and other websites to you and other potentially interested users and to measure the impact of our advertisements.
Through the LinkedIn Insight Tag, your browser establishes a connection with LinkedIn and sets a cookie with the information that you have accessed our website or clicked on an ad of ours, once they have agreed to the use of cookies requiring consent. If you are registered with LinkedIn, LinkedIn can associate the visit with your account. Among other things, we may receive demographic information (e.g., job title, employer, industry) of our website visitors who are registered on LinkedIn, which allows us to better target our marketing strategy. We also use conversion tracking to measure website visitor actions (e.g., purchase of a product), and such measurement may occur across devices (e.g., PC to tablet). We do not receive any identifying personal data, only reports and communications about website audience and ad performance. The LinkedIn Insight Tag also collects metadata (e.g. IP address, device and browser properties, timestamp). IP addresses are truncated or hashed in the event they are used to reach LinkedIn members across devices. Direct member identifiers are removed by LinkedIn within 7 days for pseudonymization purposes. The remaining pseudonymized data is deleted by LinkedIn within 90 days.

Facebook Pixel by Meta
We use the Facebook Pixel service of Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, parent company: Meta Platforms, Inc., 1601 Willow Road Menlo Park, CA 94025, USA (hereinafter “Facebook”), to display advertisements on Facebook and other websites to you and other potentially interested users and to measure the impact of our advertisements.

Through the Facebook Pixel, your browser establishes a connection with Facebook, which allows user data such as IP address or user ID to be matched, and sets a cookie for 180 days with the information that you have accessed our website or clicked on an ad of ours once you have agreed to the use of cookies requiring consent. If you are registered with Facebook, Facebook can assign the visit to your account. Using the “Custom Audience” function, we can retarget you and other website visitors within 180 days through interest-based advertising on Facebook or third-party websites. Through the “Conversion” function of the Facebook pixel, we can also measure actions of visitors on our website (e.g. the purchase of a product). Google Analytics
We use the Google Analytics service of Google Ireland Limited, Gordon House, Barrow Street Dublin 4, Ireland; parent company: Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”). This service enables an analysis of the use of our internet pages and uses cookies for this purpose.

For this purpose, the information generated by the cookie, such as your anonymized IP address, device and browser characteristics, session duration, pages visited, is transmitted on our behalf to a Google server, where it is stored and analyzed.

On this website, Google Analytics has been extended by the code “gat._anonymizeIp();”. This ensures an anonymized collection of IP addresses. Google Ads Conversion
We use the online advertising program “Google Ads” on our website and in this context conversion tracking (visit action evaluation). Google Conversion Tracking is an analysis service provided by Google Ireland Limited, Gordon House Barrow Street Dublin 4, Ireland; parent company: Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”).
When you click on an ad placed by Google, a cookie for conversion tracking is placed on your computer. These cookies have a limited validity, do not contain any personal data and are therefore not used for personal identification. If you visit certain pages of our website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page. Each Google Ads customer receives a different cookie. Thus, there is no way that cookies can be tracked across Ads customers’ websites. The information obtained with the help of the conversion cookie is used for the purpose of creating conversion statistics. Here, we learn the total number of users who clicked on one of our ads and were redirected to a page tagged with a conversion tracking tag. Google Tag Manager
This website uses Google Tag Manager, a service provided by Google Ireland Limited, Gordon House Barrow Street Dublin 4, Ireland; parent company: Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”). Google Tag Manager is a solution that allows marketers to manage website tags through one interface. The Tag Manager tool itself (which implements the tags) is a cookie-less domain and does not collect any personal data. The tool takes care of triggering other tags, which in turn may collect data. Google Tag Manager does not access this data. If a disable has been set at the domain or cookie level, it will remain in place for all tracking tags implemented with Google Tag Manager.

Personio
We use Personio, a service provided by Personio GmbH, Rundfunkplatz 4, 80335 Munich, Germany, for our applicant management. The service is used by us to effectively and efficiently design the applicant management and application process.
Personal data (e.g. first name, last name, home address, e-mail address) and application data (e.g. cover letter, resume, proof of qualification, photograph) are processed, among other things.
Data processing is based on your consent pursuant to Art. 6 (1) lit. a DSGVO when applying to us. You can revoke this at any time by notifying us via datenschutz@jom-group.com. The lawfulness of processing operations which have already been carried out remain unaffected by the revocation.

UserCentrics
On this website, we use the Usercentrics Consent Management Platform as a consent management tool. This is a service provided by Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, Germany (hereinafter “Usercentrics”).
The Usercentrics Consent Management Platform collects log file and consent data using JavaScript. This JavaScript enables us to inform users about their consent to certain tags on our website and to obtain, manage and document this consent.
We process the following data in the process:
(1) consent data (anonymized log data (consent ID, service ID, responsible party ID), consent status, timestamp).
(2) Device information (including shortened IP addresses, device information, timestamp).
(3) User data (including email, ID, browser information, setting ID, changelog).
The consent ID (contains the above data) and the consent status with timestamp are stored in the local memory of your browser and simultaneously on the cloud servers used. Further processing will only take place if you submit a request for information or revoke your consent. In this case, the corresponding information is provided in a compact data format in an easily readable text form for the purpose of data exchange (JSON file).
No user information is stored for the statistics of the use of the granted or not granted consent. Only the frequency and locations of clicks are stored.
The purpose of the data processing is the analysis, management and proof of the granted consents, in order to comply with our obligation of a DSGVO-compliant consent management.
The specific processing purposes of the personal data are:
(1) Obtaining and providing the consents.
(2) Providing evidence of which device you used to provide consent and when.
(3) Ensuring access to settings and documenting changes.
The legal basis for the management of your consents for the processing of your personal data is Art. 6 para. 1 lit. a, c and f DSGVO. Our legitimate interest lies in the legally compliant documentation and verifiability of consents, the targeting of marketing measures based on the consent granted, and the optimization of consent rates.
The data is generally deleted as soon as it is no longer required. The cookie used has a term of 60 days. The data relating to revoked consent is retained for a period of three years.
